Remote Purchase · Power of Attorney · Mexico Real Estate
Thousands of foreign buyers close on Mexican properties each year without ever setting foot in the notario's office. Here's exactly how it works — and how to do it safely.
Talk to an AdvisorThe short answer
Mexico's legal system fully supports remote property transactions through a legal instrument called a Power of Attorney (Poder Notarial). A POA allows you to authorize a trusted representative — a lawyer, advisor, or family member — to sign documents, attend the notario, and complete the closing on your behalf.
This isn't a workaround or a gray area. It's a well-established legal mechanism used by Mexican citizens and foreign buyers alike. With proper structuring and a trustworthy representative, a remote purchase can be as secure as an in-person transaction — and in some cases, more efficient.
What determines whether a remote purchase is safe is not the mechanism itself, but who prepares the POA, who holds it, and what oversight is in place throughout the transaction.
Step-by-step process
Amanah conducts your property search on your behalf, using a detailed brief of your requirements — location, budget, property type, and investment objectives. We shortlist candidates, conduct site visits, and provide photo documentation and advisory reports so you can evaluate options without traveling.
Can be done 100% remotelyBefore any offer is made, we conduct full due diligence on title history, liens, ejido status, encumbrances, and zoning. You receive a written due diligence report and our advisory recommendation before any commitment is made.
Completed on your behalf by AmanahWe prepare a carefully scoped POA that authorizes a named representative to act on your behalf for the specific transaction. The POA is signed before a notary public in your home country, apostilled, and transmitted to Mexico. We coordinate the entire apostille and translation process — you sign once, and we handle the rest.
Critical step — scope mattersAmanah submits and negotiates the offer on your behalf. Once terms are agreed, a promissory purchase agreement (contrato de promesa de compraventa) is executed — this locks in the price, terms, and timeline. Your representative signs under the POA.
Your interests, protected in writingWe coordinate the compliant international transfer of closing funds in accordance with Mexico's anti-money-laundering (LFPIORPI) requirements. Your representative attends the notario's office to formalize the escritura (deed) and receive keys. You receive a certified copy of the registered deed and confirmation of title registration.
Full completion — no travel requiredRisks & safeguards
Remote purchases carry real risks if not structured correctly. The most common failure points:
Overly broad Power of Attorney
A POA that grants general authority — rather than authority scoped to a specific property and transaction — exposes you to significant risk. Amanah always structures narrow, transaction-specific POAs. The document names the property, the parties, the permitted acts, and an expiration date.
Unverified representatives
Never grant POA to a real estate agent, developer representative, or person you haven't independently vetted. Your representative must be someone whose interests are fully aligned with yours — not with the seller. Amanah provides or vets all representatives used in remote transactions we manage.
Non-compliant funds transfer
Mexico requires documentation of the legal origin of funds for real estate transactions above certain thresholds. Non-compliant transfers can delay or invalidate closings. We coordinate transfers with Anti-Money Laundering (AML) compliance built into the process.
How we work
We've structured remote purchases for buyers in the United States, Canada, Europe, and the Middle East. Our process is designed to give you complete oversight without requiring your physical presence at any stage of the transaction.
"I bought my apartment in Roma Norte from Austin without taking a single flight. Amanah handled everything — the site visits, the negotiation, the notario. I signed a POA at a local UPS store, got the apostille handled, and received the deed six weeks later. The whole thing was smoother than buying in Texas."
